This is a legal agreement between end user and Hong Kong SeaOne Information Technology Limited. The Products developer and owner of the software. Please read the End User License Agreement Carefully.
1. License
End user may use the free or trial version of Seaone‘s products. Before deciding upon the purchase, End user may use the free or trial for evaluation. After the trial is expired, end user should purchase full version.
2. Permitted use of the software
Once installation and purchasing, the user is granted an unexclusive license to use. Seaone’s products on one computer, for any legal purpose, at a time. User need a license for a machine on which the software is installed. The license of seaone’s software may not be rented or leased but can be permanently transferred, if the person who receiving it agrees to the terms of this license. If the software is update, the transfer must include the update and all previous versions.
Seaone‘s products free or trial version may be freely distributed, if the distribution package is not modified. No person or company may charge a fee for the distribution of seaone’s products free or trial version without written permission from the copyright holder.
OUR PRODUCTS IS DISTRIBUTED “AS IS”. NO WARRANTY OF ANY KIND IS EXPRESSED OR IMPLIED. YOU USE AT YOUR OWN RISK. THE AUTHOR WILL NOT BE LIABLE FOR DATA LOSS, DAMAGES, LOSS OF PROFITS OR ANY OTHER KIND OF LOSS WHILE USING OR MISUSING THIS SOFTWARE.
3. License Restrictions
3.1 Licensee may not and agrees not to or enable others to modify, adapt, translate, sublicense, rent, lease, or loan all or any portion of the Licensed Software; Any such unauthorized use shall result in immediate and automatic termination of this license and may result in criminal and/or civil prosecution.
3.2 Licensee may not and agrees not to or enable others to create any derivative works from all or any portion of the Licensed Software or Documentation; and Licensee may not reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Licensed Software; and
3.3 Licensee may not and agrees not to or enable others to use a previous version of the Licensed Software after receiving a media replacement or upgraded version as a replacement to a prior version (in such case Licensee must destroy the prior version); and
3.4 Licensee may not and agrees not to or enable others to remove or obscure Licensor’s copyright or trademark notices, or the copyright and trademark notices of any third parties that Licensor has included in the Licensed Software or Documentation; and
3.6 Licensee may not install the Licensed Software on other devices after the Licensed Software has been installed on one device without Licensor’s prior consent.
4. COPYRIGHT
The SOFTWARE is owned by Hong Kong SeaOne Information Technology Limited and is protected by International copyright laws and treaty provisions.
Seaon’s trademark of Hong Kong SeaOne Information Technology Limited. All other trademarks are the property of their respective owners.
5. Software Support
Support will only be provided by e-mail and only on the most current version. Queries regarding the installation and use of the SOFTWARE should be submitted by e-mail to support@seaones.com. If users have questions about buying or updating our products, please Email at market@support.com Requests for additional features and enhancements should be submitted by e-mail to support@seaones.com. We will attempt to implement all reasonable requests but is not obliged to implement it.
6. Software Upgrade
Licensor may provide Licensee with Software Updates and/or Content Updates from time to time at no charge during the Term of this Agreement. The Licensor may, at its sole discretion, decide if Licensee can get Software Updates and/or Content Updates free of charge or the Licensee has to pay for the Updates. For the purposes hereof, “Update” means a new version of the Licensed Software containing technical modifications, updated information, altered functionality, or any other changes that are intended by Licensor to improve or to add, delete or otherwise modify any aspect of the Licensed Software. If the Licensed Software is an Update to a previous version, Licensee must possess a valid License to the previous version. Any update provided by the Licensor to Licensee is made on a License exchange basis such that Licensee agrees, as a precondition for receiving an Update, that Licensee will terminate all of Licensee’s rights to use any previous version of the Licensed Software. However, Licensee may continue to use the previous version only to assist in transitioning to the Updated version. Once an Update has been released, the Licensor may cease service or support for prior versions, without any notice to Licensee. Software Updates may be provided via the Licensed Software or on the websites（www.seaones.com）. This License does not permit Licensee to obtain and use a Software Upgrade and/or a new Licensed Software version.
7. Feedback
When you have question, suggestion, tips, data or other information (collectively referred to as Information, including but not limited to any ideas, concepts or technologies to improve the Software and Software-related service), regardless of the method used or accompanying media, to Seaone Software, as feedback, data, questions, comments, suggestions, etc., all such Information shall be deemed unrestricted and non-confidential. Moreover, you agree that Seaone has a permanent, inalienable, non-exclusive right to use such Information worldwide, without any obligation to pay, compensate or reward you (including without limitation to the extent the Information is included in or the basis of any modifications to the Software).
8. Termination
This EULA remains in full force and effect for the term of the applicable license, unless earlier terminated in accordance with the provisions herein. You may terminate this Agreement at any time by uninstalling the Software and destroying all copies thereof ( if any ) in your possession or control.
9. Governing Law
This Agreement will be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to or application of the conflict of law rules or principles, and shall not apply the United Nations Convention on Contracts for the International Sales of Goods (CISG) either.
